Terms of service.
Japanese Australia offers online Japanese language classes monthly. Students have the choice to participate in group classes or individual classes. Students can also come as casual participants and pay for each lesson as they go.
1. Agreement
Japanese Australia is an online venue for Japanese language learning where registered users (‘Members’) may use our Connection Services and Payment Services to directly interact with one another. You understand and agree that Japanese Australia is not a party to any agreements entered into between Students and Teachers or between Members, nor is Japanese Australia a language services broker or agent. Japanese Australia has no control over the conduct of Students, Teachers, Members or other users of the Japanese Australia Platform or over any services provided by Teachers or other Members over the Japanese Australia Platform, and disclaims all liability in this regard to the maximum extent permitted by law.
If you choose to teach on the Japanese Australia Platform, you understand and agree that your relationship with Japanese Australia is limited to being a Member and an independent, third-party contractor, and not an employee, agent, joint venturer or partner of Japanese Australia for any reason, and you act exclusively on your own behalf and for your own benefit, and not on behalf of or for the benefit of Japanese Australia. Japanese Australia does not control, and has no right to control, your listing, your activities associated with your profile or listed services, or any other matters related to any services that you provide.
As a Member you agree not to do anything to create a false impression that you are endorsed by, partnering with, or acting on behalf of or for the benefit of Japanese Australia, including by using any Japanese Australia intellectual property in an unauthorized or inappropriate manner.
2. Location & Time
2a. Location
All classes will be held online. Japanese Australia is a trading name of Japanese Melbourne Pty Ltd and is located at Level 11, 258 Little Bourke Street, Melbourne, Australia.
2b. Class Time
Our class time zone is set to the VIC/NSW time zone (AEST). This would mean that if you are living in an area where is no daylight savings, there will be an hour difference between your lesson times.
Daylight Saving Time begins at 2am on the first Sunday in October, when clocks are put forward one hour.
On the first Sunday in April, the clocks are put back one hour.
In Australia, Daylight saving is observed in New South Wales, Victoria, South Australia, Tasmania, the Australian Capital Territory and Norfolk Island.
Daylight saving is not observed in Queensland, the Northern Territory, Western Australia, Christmas Island or the Cocos (Keeling) Islands.
3. Description of Services
3a. Japanese Australia Services
Japanese Australia’s services includes:
Connection Services. Japanese Australia provides Members with access to and use of the Japanese Australia Platform, which is an online venue where (a) Members can upload, submit, store, send and receive content related to language learning; (b) Members can conduct searches, connect with, choose, and engage each other for the purposes of language learning and instant language practice; (c) Students can conduct searches, connect with, choose, and engage Teachers directly for language instruction and Teacher Services; (d) Teachers can advertise their capabilities, respond to inquiries, connect with and engage Students to provide them with their Teacher Services (collectively, "Connection Services"). For the avoidance of doubt, in providing the Connection Services, Japanese Australia only provides the venue for Members, including Students and Teachers, to find and contract with each other, and Japanese Australia does not take part in direct interactions between Members.
Payment Services. For Students and Teachers, Japanese Australia also provides certain payment processing services, credit purchase and payment tools, dispute resolution procedures and assistance, and other services in accordance with Japanese Australia’s Payment Policy (collectively, "Payment Services"). Payment Services do not include Connection Services.
3b. Teacher Services
Teachers may provide certain Teacher Services through the Japanese Australia Platform. If you are accepted to be a Teacher, you agree to Japanese Australia 's Teacher Policy. All Members hereby acknowledge that the Teacher Services are solely provided by Teachers and are not provided by Japanese Australia. Japanese Australia’s responsibility with respect to Teacher Services is limited to facilitating the availability of the Japanese Australia Platform.
4. Payment
All fees to be paid must be in Australian currency. We reserve the right to terminate a lesson if fees are not up to date. Fees are not transferable to another student. Fees are not transferable to another month or teaching period.
4a. Monthly fees
This payment can be made by direct debit or online credit card into the Japanese Australia Account. Payment of the monthly lessons must be made in full prior to the commencement of the lesson.
4b. Single lesson fee
Payment of all fees for single lessons must be made at the time of booking the single lesson. This payment can be made by direct debit or online credit card into the Japanese Australia Account.
5. Enrolment
If the Student has purchased a lesson, their enrolment commences on the day of the month agreed by both parties; provided that:
a) the Student has returned a completed Enrolment Agreement Form or provided their contact details; and
b) Japanese Australia has received the payment in full.
6. Rescheduling
Once a lesson is booked, this is considered to be enrolment in the lesson. Rescheduled lessons will be treated as private lessons regarding their cancellation and/or non-attendance. Students may request to reschedule lessons with no less than 7 days’ notice. The teacher will respond within 36 hours from the time of the request. The success of rescheduling is subject to the teacher’s availability.
7. Cancellation and Refund Policy
In the event that a remainder of a month is cancelled by the Student, he/she is to notify Japanese Australia by phone 0430 103 660 or email hello@japaneseaustralia.com.au. The Student will be refunded the cancelled classes if notifications have been given 7 DAYS before the scheduled date.
No prior notice given by the Student / same-day cancellations / and non-attendance = full lesson fee is forfeit by the Student.
The cancelled classes without the notification will be treated as non-attendance and non-refundable.
Every lesson will be calculated as a single lesson fee.
In the unlikely event that a remainder of a month is cancelled by the School, they will arrange a make-up lesson and advise the Student of the new time and date. Japanese Australia reserves the right to cancel your enrolment without any warning or notice for serious inappropriate behaviour that is anti-social, offensive or dangerous.
8. Privacy Statement
In processing your Enrolment and throughout your Enrolment period we obtain personal information about you. The School will only use, disclose or deal with such information to the extent specifically required by law or for the purposes of this Agreement and/or your Enrolment.
9. Policies
Students agree to comply with lawful directions and policies of Japanese Australia.
We reserve the right to change the teacher at any given time with or without notice. Teachers cannot be specified by students for group lessons. Private students may pay a $50 fee per 8-week invoice to request a teacher, but this is also subject to class availability. This fee will be passed onto the teacher.
10. Copyright
The content of the online course materials, including copyright and all other such intellectual property rights contained therein, remain the property of Japanese Australia. You may not reproduce any part of the online course materials without the prior written consent of Japanese Australia.
11. Ongoing Enrolment
If a Student has enrolled in the same calendar month he/she wishes to apply for, the Student does not need to provide another signed Enrolment Form and the same terms and conditions will apply the following month.
12. Contract Transfer by the School
We may transfer our rights and obligations under this Agreement to a third party without notice and you will continue as a student.
13. Variation
This agreement may be varied from time to time at the discretion of Japanese Australia. The Student will be advised of any such changes in writing 30 days before the changes come into effect. Such changes may include the increase of fees from one term to another. Any changes that the Student has not been advised of will not be valid.
14. Miscellaneous
If part or all of any provision of this Agreement is deemed void or unenforceable, it may be severed from this Agreement and the provisions that remain will continue in force unconditionally. If the School does not enforce any rights in this agreement for any reason, the School does not waive its right to enforce it later.
